Here’s a quick look at how the Toto heads are done, and no, it’s not a Photoshop filter. These are done in Adobe Illustrator with a Wacom Tablet. The style is a ripoff of Richard Linklater’s movies Waking Life and A Scanner Darkly.

How do you handle the possible suit for copyright infringement of the original photo you use. Are you following the AP vs Shepard Fairey as it relates to the The Obama Hope poster? It seems you are doing a similar process.

Thanks for the concern, but fortunately for all of us Andy and Dan are on safe ground with the Toto. Even using those pictures in the background.

The copyright law contemplates that fair use of a copyrighted work without permission shall be for purposes such as (1) criticism and comment, (2) parody and satire, (3) scholarship and research, (4) news reporting and (5) teaching, and that such fair use will not result in the infringement of a copyrighted work.

As one may expect, authors and publishers usually take a restrictive view of the fair use doctrine, while users of copyrighted materials generally take a more expansive view.

A satirical comic that criticizes, provides comment and parody is most certainly permissible, even under the most restrictive interpretation.
